Katherine Heigl Sues Duane Reade Over Tweeted Photo

Actress Katherine Heigl has sued Duane Reade, a subsidiary of Walgreens, over tweeting a paparazzi photograph of her without first getting her permission. Katherine is holding Duane Reade bags in the photo. The Duane Reade tweet said, "Love a quick Duane Reade run? Even Katherine Heigl can't stop shopping NYC's favorite drugstore." The tweet and photo have since been removed. Us reports that a source tells them Kathrine tried to settle the incident privately before filing suit.

Attorney Alison Triessl tells ABC News that Katherine has a strong case. She says, "Katherine Heigl is on great legal footing here. Duane Reade used her likeness and her image without her consent so that they could advertise and financially gain from it."

ABC's legal analyst Dan Abrams thinks it is a tough case. He says she is going to have to show that people would think the tweet by Duane Read was an endorsement. Take a look:
